Privacy Policy.
NewBuild Telecom Consulting respects the confidentiality of every developer, tenant, and capital partner we engage with. This policy describes what information we collect, how we use it, and how we protect it.
1. Who we are
NewBuild Telecom Consulting (New Build Telecom LLC, a Colorado limited liability company) ("NewBuild," "we," "us") is an outside-plant fiber advisory practice headquartered in Denver, Colorado. This policy covers information collected through this website, our order and request forms, and our engagements. Our services are offered to businesses.
2. Information we collect
We collect information you provide to us and information collected automatically when you use this site:
- Contact details. Name, title, company, email, and phone number you submit through forms on this site or in direct correspondence.
- Site and order information. Site addresses, coordinates, parcel descriptions, tier requirements, intended use, site counts, service selections, notes, and any other details you share for a Snapshot, request, or engagement. Information you enter on our order form is sent to us when you continue to payment, even if you do not complete checkout.
- Payment information. Payments are processed by our payment provider. We receive confirmation of payment and limited billing details. We do not receive or store full card numbers.
- Terms acceptance records. When you check the Terms & Conditions box and continue to payment, we record the date and time, your IP address, your browser, your order details, and the version of the Terms you accepted.
- Usage information. Server logs (IP address, browser and device type, referring page, pages visited, and timestamps) and analytics data described in Section 3.
- Communications. Emails and messages you send us, and our replies.
3. Cookies and analytics
We use Microsoft Clarity to understand how visitors use this site and to improve it. Clarity captures how you use and interact with our website through behavioral metrics, heatmaps, and session replay, and uses first- and third-party cookies and similar technologies to collect this data. For more information about how Microsoft collects and uses data, see the Microsoft Privacy Statement.
We also use Google Analytics, loaded through Google Tag Manager, to measure site traffic and actions such as form submissions and checkouts. Google Analytics uses cookies and similar technologies to collect this data. For more information, see How Google uses information from sites that use its services.
We also keep a simple daily visitor count on our own server. To count each visitor once per day, we store a one-way hashed identifier created from your IP address and browser type with a key that changes daily. We do not store your IP address, do not set a cookie for this count, and delete these records after 35 days.
This site loads fonts from Google Fonts, so your browser connects to Google servers, which receive your IP address. You can block or delete cookies through your browser settings; parts of the site may not work as intended if you do. This site does not currently respond to browser "Do Not Track" signals.
4. How we use information
We use information to:
- Deliver the Snapshot, analysis, engineering, or implementation work you request, and respond to inquiries and call requests.
- Process payments, send receipts, and keep business records.
- Communicate with you about orders, requests, and engagements.
- Prevent fraud and abuse, enforce our Terms & Conditions, collect amounts owed, and respond to payment disputes.
- Comply with legal, accounting, and tax obligations.
- Operate, secure, and improve this website and our services.
We may use aggregated or de-identified information that does not identify you, your company, or your sites to improve our methodology and services.
5. How we share information
Confidentiality is core to how we work. We do not sell your information, and we do not share it with carriers, tenants, or competitors unless a service you order requires it, such as carrier engagement. We share information only in these cases:
- Services you order. When a service you order requires sharing, such as carrier engagement or coordination during engineering and implementation work, we share only the information that work needs.
- Service providers. Companies that help us run the business and this site, including our payment processor (Stripe), form delivery service (Web3Forms), analytics providers (Microsoft Clarity and Google Analytics), email provider (Google Workspace), and web host. They receive only the information needed for their service.
- Payment disputes. If a charge is disputed, we may provide your order details, our records of your request and delivery, and your Terms acceptance record to our payment processor and your card issuer.
- Legal and protection. When required by law or valid legal process, or when we believe it is necessary to protect our rights, property, or safety, enforce our Terms, or collect amounts owed.
- Business transfers. If NewBuild is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this policy.
6. Confidentiality of engagement materials
Site lists, route designs, capacity plans, and tenant information shared with us during an engagement are treated as confidential by default. We will sign mutual non-disclosure agreements at a client's request and routinely do so before exchanging carrier-sensitive material.
7. Data retention
We keep information for as long as needed to provide our services, maintain business and tax records, comply with legal obligations, resolve disputes, and enforce our agreements. Terms acceptance records and order records are kept for as long as they may be needed to respond to a payment dispute or legal claim. Inquiry records are reviewed for deletion periodically.
8. Security
We use commercially reasonable administrative, technical, and physical safeguards to protect information. No website, email, or storage system is completely secure, and we cannot guarantee the security of information you send us. Email is not a secure channel, so please do not send payment card numbers or other highly sensitive information by email or through our forms. If we become aware of a security incident that materially affects you, we will notify you as required by applicable law.
9. Your choices
You may request access to, correction of, or deletion of your personal information by writing to contact@newbuildtelecomconsulting.com. We may need to verify your identity before acting on a request. We will respond as required by applicable law, keeping records we are required or permitted to keep, such as order, payment, tax, and Terms acceptance records.
10. Business users only
This site and our services are intended for businesses and are not directed to individuals under 18. We do not knowingly collect information from anyone under 18.
11. Where information is processed
NewBuild is based in the United States, and information is processed and stored in the United States by us and our service providers.
12. Third-party links
This site may link to websites we do not control. We are not responsible for their content or privacy practices.
